The state exempted virtual currency from its Money Transmitter Act in March 2018, created the SPDI bank charter for crypto custody in 2019, and approved Kraken Bank as the first crypto bank charter in the country in September 2020; DAO recognition and a utility token exemption round out the stack. Is bitcoin legal in Wyoming?

Bitcoin is legal in Wyoming, the state that has gone furthest to accommodate it. HB 19, signed March 5, 2018, exempts virtual currency from the Wyoming Money Transmitter Act, so exchanges need no state license, and the special purpose depository institution (SPDI) charter created in 2019, supervised by the Wyoming Division of Banking, lets crypto companies operate as full-reserve banks. Kraken Financial received the first SPDI charter in September 2020. Federal FinCEN registration still applies to exchanges.

Wyoming collects no state income tax, so the state takes nothing when you sell bitcoin at a gain. Federal capital gains tax still applies in full, and exchanges report to the IRS the same way they do in every state.
