The Digital Financial Assets Law, signed as AB 39 in October 2023, made the Department of Financial Protection and Innovation the state's crypto licensing authority: DFPI opened license applications through the Nationwide Multistate Licensing System on March 9, 2026, and covered platforms have needed a license or a pending application since July 1, 2026 to keep serving Californians. Money transmission licensing under the state's Money Transmission Act continues to apply alongside the new regime.

California taxes capital gains as ordinary income, with no reduced rate for long-term holdings, so your bitcoin gains land in the same state brackets as your salary. Federal capital gains tax applies on top of the state bill.
