A licensing countdown just hit zero in California: since July 1, 2026, any crypto platform serving state residents must hold, or have a pending application for, a Digital Financial Assets Law license from the Department of Financial Protection and Innovation, layered on top of the state's Money Transmission Act. The new regime has not thinned your options: all eight exchanges we track, from Coinbase and Kraken to River, Swan Bitcoin, and Binance.US, serve California. A free ACH transfer is the standard way to fund any of them; debit cards cost more but settle instantly. One planning note before you buy: California taxes crypto gains as ordinary income with no lower rate for long-term holding, so the state's famously high brackets apply to your bitcoin too.

Is bitcoin legal in California?

Bitcoin is legal in California. The Digital Financial Assets Law, signed as AB 39 in October 2023, made the Department of Financial Protection and Innovation the state's crypto licensing authority: DFPI opened license applications through the Nationwide Multistate Licensing System on March 9, 2026, and covered platforms have needed a license or a pending application since July 1, 2026 to keep serving Californians. Money transmission licensing under the state's Money Transmission Act continues to apply alongside the new regime.

California taxes capital gains as ordinary income, with no reduced rate for long-term holdings, so your bitcoin gains land in the same state brackets as your salary. Federal capital gains tax applies on top of the state bill.

Frequently asked questions

Is buying bitcoin legal in California?

Yes. Buying, holding, and selling bitcoin is legal throughout California. Since July 1, 2026 the platforms you buy from must be licensed under the Digital Financial Assets Law or have an application pending with the DFPI, which adds oversight for companies rather than restrictions on you.

What does the Digital Financial Assets Law mean for me?

DFAL is a licensing law aimed at businesses, not individuals. Exchanges serving Californians must register with the Department of Financial Protection and Innovation, which gains examination and enforcement power over them. You do not need any license to buy or hold bitcoin yourself.

Can I use any major exchange from California?

Yes. All eight platforms we track, including Coinbase, Kraken, Gemini, River, Swan Bitcoin, Strike, Binance.US, and Coinmama, accept California residents.

How is bitcoin taxed in California?

California treats capital gains as ordinary income, so there is no discounted long-term rate at the state level. You also owe federal capital gains tax, which does distinguish short-term from long-term holdings. Keep purchase records from your first buy.

How can I keep fees low when buying bitcoin in California?

Link your bank account and fund with ACH, which the major exchanges offer free, then trade on the platform's advanced interface instead of the instant buy button. Debit card purchases settle instantly but carry a percentage fee.
