The Department of Banking licenses money transmitters under the state's Money Transmission Act, and Public Act 15-53, with virtual currency provisions effective October 1, 2015, expressly brought transmitting monetary value in the form of virtual currency inside that regime, giving the Banking Commissioner discretion to impose extra conditions such as larger surety bonds on crypto licensees. A 2022 advisory restated that transmitting without a license violates state law.
