Bitcoin is legal in Florida. The Office of Financial Regulation licenses money transmitters under Chapter 560 of the Florida Statutes, and the legislature has updated crypto's legal footing twice: House Bill 1379 added virtual currency to the state Money Laundering Act effective July 1, 2017, and House Bill 273, signed in May 2022, wrote a virtual currency definition into the money transmission code from January 1, 2023, requiring a license for intermediaries that transmit crypto between parties while leaving direct two-party sales outside it.
Florida levies no personal income tax, so selling bitcoin at a profit triggers no state tax bill. Federal capital gains tax still applies to every sale.
