Bitcoin is legal in Nevada. Money transmission is regulated by the Financial Institutions Division under NRS Chapter 671, and exchanges apply through the NMLS with a dedicated virtual currency addendum covering trading, custody, lending, and mining activity. Assembly Bill 21 of 2023 began aligning the statute with the multistate Money Transmission Modernization Act, and the division published draft implementing regulations in August 2023. Federal FinCEN rules apply regardless of the state license.

Nevada has no personal income tax, so bitcoin gains face no state-level tax when you sell. Federal capital gains tax applies as it does everywhere in the country.
