Bitcoin in Massachusetts: the licensing picture
Bitcoin is legal in Massachusetts. The Division of Banks long licensed only foreign transmittal agencies under MGL chapter 169, and its advisory opinions, including Opinion 22-002, found that exchanging virtual currency for fiat did not by itself trigger that license. Chapter 312 of the Acts of 2024 replaced the old regime with a comprehensive money transmission law, MGL chapter 169B, and the Division began licensing money transmitters under it on January 1, 2026. Federal registration and tax rules apply regardless.
Massachusetts taxes short-term capital gains, on assets held one year or less, at 8.5 percent, a rate cut from 12 percent for tax years beginning January 1, 2023, and most long-term gains at 5 percent. Federal capital gains tax applies on top of the state bill.
