The Department of Financial Institutions set the state's position in a December 16, 2015 memo: cryptocurrency is not money under the Tennessee Money Transmitter Act, so two-party crypto trades and plain crypto transfers are unlicensed activity, while exchanging crypto for dollars through a third-party exchanger is generally money transmission that requires a license. TDFI has since moved the state onto the multistate Money Transmission Modernization Act, covered in its October 2023 implementation memo.
