The Departament de Tributs i de Fronteres treats a resident individual's transfer of digital currencies, outside any professional activity, as a capital gain or loss under articles 24 to 26 of the personal income tax law (Llei 5/2014, IRPF). Binding ruling CV0337-2025 of 7 March 2025 states that the gain or loss is the difference between the acquisition value and the transfer value, and that it is imputed at the moment of the transfer or conversion. The ruling also states that Law 24/2022 on digital assets does not amend or repeal Law 5/2014, so only the IRPF law and the Department's own published criteria decide how the income is qualified, determined and valued. The ruling does not state the IRPF rate, so this draft carries none.
