You pay Croatian income tax on capital gains from trading bitcoin and other cryptocurrencies. You must calculate, withhold, and pay tax on prior-year capital gains by the last day of February, and submit the JOPPD report to Porezna uprava by the end of February under articles 78 and 79 of the Income Tax Regulation.

What is not taxed

  • A crypto to crypto exchange does not establish capital gains income when there is no cash flow and no conversion into a currency recognized as legal tender.
  • A capital gain is taxed only where the financial asset was acquired from 1 January 2016 onward and disposed of within 2 years of the acquisition date.
  • Bitcoin received through the sale of your own personal property is a non-taxable receipt under article 8 paragraph 2 point 4 of the Income Tax Act.
  • Bitcoin received as a gift is a non-taxable receipt if the conditions in article 8 paragraph 2 point 3 of the Income Tax Act and article 4 paragraph 5 of the Income Tax Regulation are met.
