The personal income tax code, the Codigo do IRPS approved by Lei n. 78/VIII/2014 and in force since 1 January 2015, is hosted in the DNRE legislation library, and none of its articles name crypto, virtual or digital assets. The code taxes an individual's income in five categories: dependent work and pensions (A), business and professional income (B), property income (C), capital income (D) and ganhos patrimoniais, or gains on assets (E). Article 1(3) says income in cash or in kind is taxable wherever it is obtained and whatever the currency or form in which it is earned. Article 17 lists the Category E gains: sales of real estate rights, contractual positions on real estate, partes sociais and other valores mobiliarios, intellectual or industrial property, and unjustified increases in wealth, plus gambling and lottery winnings. The code does not say whether a gain on bitcoin falls in any of those lines, and the copy in the DNRE library is the original 2014 text.

How does Cape Verde tax a gain on selling an asset?
Article 17 of the IRPS Code lists Category E gains: sales of real estate rights, of partes sociais and other valores mobiliarios, of intellectual or industrial property, and unjustified increases in wealth. Article 40 taxes them on the gross value by a final withholding with no aggregation option, and article 50 sets the rate at 1% for those gains and 20% for gambling, lottery and prize winnings. Does income earned in a foreign currency count in Cape Verde?

Article 1(3) of the IRPS Code taxes income wherever it is obtained and whatever the currency or form in which it is earned, and article 25 converts amounts in a currency without legal tender in Cape Verde to escudos at the official buying rate on the date paid, or at the 31 December rate if that cannot be proven.
