Montana is the one state with no money transmitter licensing law on the books, so there has never been a state license standing between you and a bitcoin exchange. All eight exchanges we track serve Montana with full service: Coinbase, Kraken, Gemini, Binance.US, River, Swan Bitcoin, Strike, and Coinmama all take Montana customers. There is simply no transmitter statute for the Division of Banking and Financial Institutions to apply, and the legislature leaned further in with SB 178, a right to mine law signed in May 2023 that blocks local mining bans and discriminatory electricity rates for miners. Link a bank account and fund by ACH for free; wires and debit cards cost more but settle faster. Federal rules, including FinCEN registration for exchanges, apply as they do everywhere.

Is bitcoin legal in Montana?
Bitcoin is legal in Montana, which stands alone among the fifty states in having no money transmitter licensing statute at all. The Montana Division of Banking and Financial Institutions licenses banks and lenders but has no transmitter regime to stretch over crypto, so exchanges serve residents without any state-level license. Exchanges still register federally with FinCEN as money services businesses.

Frequently asked questions
Can I legally buy bitcoin in Montana?
Yes. Montana has no money transmitter licensing law, so exchanges face no state license requirement at all. Buying, holding, and selling bitcoin are legal under federal law, which applies in every state.
Does any exchange skip Montana?
No. All eight platforms we track serve Montana with no restrictions, which puts it in the small group of states with completely clean exchange coverage.
What did Montana's right to mine law change?
SB 178, signed in May 2023, stops local governments from banning bitcoin mining, bars discriminatory electricity rates for miners, and blocks extra taxes on crypto used as payment. It affects miners and merchants more than everyday buyers, but it signals where the state stands.
How do most Montanans fund a bitcoin purchase?
By ACH bank transfer, which is free on the major exchanges and settles in a few business days. Debit cards and wires are the faster, costlier options.
