Is bitcoin legal in Vietnam?
Bitcoin is legal to own in Vietnam and illegal to spend, and from 1 September 2026 it is penalised to trade on an unlicensed platform. The Law on Digital Technology Industry, effective 1 January 2026, recognises crypto assets as property, and Resolution 05/2025 established a five-year pilot for licensed exchanges under the Ministry of Finance. Decree 284/2026, issued on 16 July 2026 and in force from 1 September 2026, is the first measure to penalise the individual trader rather than the platform: domestic investors who trade through a provider not licensed by the Ministry of Finance face fines of 30 to 50 million dong, rising to 70 to 100 million dong for assets reserved to foreign investors. The licensing window opened on 20 January 2026 and is capped at five operators, with minimum charter capital of 10 trillion dong and foreign ownership limited to 49 percent; no exchange had been licensed as of August 2026. Crypto remains barred as a means of payment.
