Is buying bitcoin with BPAY legal in Australia?
Bitcoin is fully legal in Australia. Exchanges must register with AUSTRAC and meet anti-money-laundering obligations, a requirement in force since April 2018, with expanded obligations under the 2024 AML reforms phasing in from July 2026. The Corporations Amendment (Digital Assets Framework) Act received royal assent in April 2026 and will require digital asset platforms to hold an Australian Financial Services Licence from ASIC once the framework commences in April 2027. The ATO treats bitcoin as a capital gains tax asset.
