Bitcoin in New York: the licensing picture
Bitcoin is legal in New York, but the state operates the most demanding licensing regime in the country. Since June 2015, any company conducting virtual currency business with New York residents has needed a BitLicense from the New York Department of Financial Services under 23 NYCRR Part 200, or a limited purpose trust charter under state banking law, alongside a New York money transmitter license. DFS grants approvals sparingly, which is why several national exchanges simply geofence the state.
New York has no reduced rate for long-term capital gains: bitcoin profits are taxed as ordinary income at some of the highest state rates in the country, and New York City residents owe an additional local income tax on top. Federal capital gains tax applies as well.
