Your shortlist shrinks the moment you cross into New York: of the eight exchanges we track, only Coinbase, Gemini, Swan Bitcoin, and Strike will open an account for a New York resident. Kraken, River, Binance.US, and Coinmama all sit the state out rather than carry a BitLicense, the approval the Department of Financial Services has required under 23 NYCRR Part 200 since 2015. Gemini is the home-turf pick, a New York trust company chartered by NYDFS itself, and Strike is the newest arrival, switched on for New York in March 2026 under a fresh BitLicense. Fund whichever you pick with a free ACH transfer. The consolation of America's toughest crypto regime: every platform still standing has been vetted harder here than anywhere else in the country.

Is bitcoin legal in New York?

Bitcoin is legal in New York, but the state operates the most demanding licensing regime in the country. Since June 2015, any company conducting virtual currency business with New York residents has needed a BitLicense from the New York Department of Financial Services under 23 NYCRR Part 200, or a limited purpose trust charter under state banking law, alongside a New York money transmitter license. DFS grants approvals sparingly, which is why several national exchanges simply geofence the state.

Taxes in New York

New York has no reduced rate for long-term capital gains: bitcoin profits are taxed as ordinary income at some of the highest state rates in the country, and New York City residents owe an additional local income tax on top. Federal capital gains tax applies as well.

Frequently asked questions

Is bitcoin legal in New York?

Yes, fully legal to buy, hold, and sell. What is restricted is the business side: since 2015, companies serving New York residents have needed a BitLicense or a trust charter from the Department of Financial Services, which is why fewer platforms operate here than in other states.

Why do Kraken and Binance.US refuse New York customers?

Neither holds a BitLicense, and complying with 23 NYCRR Part 200 is costly enough that both geofence the state instead of applying. River and Coinmama sit out New York for the same reason.

Which platforms actually work for New York residents?

Coinbase, Gemini, Swan Bitcoin, and Strike. Gemini is chartered by NYDFS as a New York trust company, and Strike joined in March 2026 after receiving its own BitLicense.

What is the cheapest way to buy bitcoin in New York?

Connect your bank and fund with a free ACH transfer, then place limit orders on Gemini ActiveTrader or Coinbase Advanced rather than the simple buy screen. Card purchases add a fee for speed you rarely need.
